Question: What kind of marks may not be registered?

Answer:
A person may not register a mark that is deceptive, immoral, or scandalous. Also, trademarks related to a belief, an individual, an institution or a national symbol are not permitted.


Question: Who may file an application?

Answer:
Only the owner of the trademark may file an application for its registration. An application filed by a person who is not the owner of the mark will be declared void.

Question: When was the trademark law treaty in place?

Answer:
Adopted on October 27, 1994, entered into force on August 1, 1996. Thirty-three states, including the United States, are party to the TLT as of July 1, 2005.

Definition:

Definition:
A person residing within the United States who is appointed by a patentee or assignee of a trademark application or registration that does not reside in or is not domiciled within the United States.

Definition:
An exception to the exclusive right of a copyright owner to distribute copies or phonorecords of the copyrighted work.
